Terms of Service

1. Who we are

Censatim is owned and operated by Oak Sustainability Limited, a company registered in England and Wales (company number 17275639) with registered office at 71-75 Shelton Street, Covent Garden, London, United Kingdom, WC2H 9JQ (“Censatim”, “we”, “us”). Contact: support@censatim.com.

2. The service

Censatim provides software-based assessments of eligibility and alignment under Regulation (EU) 2020/852 (the EU Taxonomy) and its Delegated Acts, together with related informational content. Assessments are produced by Censatim’s own assessment engine and criteria database, with large language models applied to the information and documents you supply and referenced against the Taxonomy criteria.

Eligibility assessment is provided free of charge. Paid scopes, prices, and any usage limits are as displayed on the site at the time of purchase; payment is taken after the assessment is complete and before the full report is released. The service is intended for business use, and the full report is made available immediately on payment.

3. Not professional advice

Outputs are an analytical starting point, and are intended to serve as an indication, not a conclusion you should act on alone. They do not constitute professional, legal, regulatory, audit, assurance, investment, or tax advice; a formal opinion; or a guarantee of regulatory compliance. You should have findings reviewed by a qualified practitioner before relying on them in disclosures, financing, investment decisions, or regulatory submissions. 4. Your responsibilities

• Provide accurate and lawful information. Assessment quality depends on input quality; outputs assume your inputs are true and complete.
• Only upload documents you have the right to share. Do not upload unlawful content or unnecessary personal data.
• Do not misuse the service: no attempts to circumvent usage limits or payment, probe or disrupt security, scrape or bulk-extract the underlying data or prompts, use outputs to build a competing automated assessment service, or misrepresent an AI-assisted report as a formal or practitioner-signed opinion.
• If you create an account, keep your access secure; you are responsible for activity under it.

5. Payment and refunds

Prices are stated on the site and are payable on completion of the assessment, before the full report is released. Because a report is delivered in full at that point, it is not refundable once released, except as set out in section 6, where required by law, or where we fail to deliver the service. If a technical failure on our side prevents delivery of a paid report, we will re-run it or refund it. Where you ask to be invoiced, the report is released once the invoice is paid. Nothing in these terms affects your statutory rights.

6. Accuracy commitment

We stand behind the analysis in our paid reports. If you identify a factual or technical error in a paid alignment report, email support@censatim.com quoting the report reference and describing the error. Where the claim is substantiated we will correct the finding and reissue the report under the same reference, refund in full the fee you paid for it, and pay you a further £50.

For this purpose, a factual or technical error means a finding in the report that is contradicted by:

• the text of the EU Taxonomy criteria applied, as reproduced in the report’s annex and in force at the date of issue; or
• the information and documents you provided during the assessment, as recorded in the report’s question and answer annex.

The commitment is directed at the substance of the Taxonomy analysis. The following are not errors for this purpose:

• conclusions affected by information that was inaccurate, incomplete, or not provided at the time of assessment;
• changes to the Delegated Acts, guidance, or their interpretation taking effect after the report’s date of issue;
• matters of interpretation or professional judgement on which qualified practitioners may reasonably differ, including the weight given to evidence and the confidence grade attached to a finding;
• a criterion recorded as undetermined, or listed as an information gap, where the evidence needed was requested and not supplied;
• typographical, formatting, or presentational matters that do not change a finding; and
• website faults, downtime, delivery failures, or any other technical or service issue that does not affect the substance of a finding. Those are dealt with under section 5.

Claims must be made within three months of the date of assessment stated on the report. Claims are assessed by a qualified practitioner and we aim to respond within 14 days of receiving one. The commitment applies to paid alignment reports only, not to free eligibility assessments, and is limited to one payment per report, payable to the customer who paid for it. We may amend or withdraw this commitment at any time in respect of reports issued after the change; reports already issued keep the commitment in the form published when they were issued. Nothing in this section affects your statutory rights.

7. Intellectual property

We retain all rights in the service, including its software, prompts, design, and content. You retain all rights in the information and documents you upload, and you grant us a limited licence to process them solely to provide the service. You may use the reports we generate for your own business purposes, including sharing them with your advisers, lenders, and investors, provided the disclaimers are not removed.

Your reports are confidential and we will not publish them. We publish worked examples on our website, but only ones you have expressly permitted by ticking the publication box shown before payment, which is unticked by default. You may withdraw that permission at any time by emailing support@censatim.com, and we will remove the report from the site.

8. Data

Our handling of personal data is described in the Privacy Policy, and our security practices at Trust & Security. Uploaded documents are processed to extract assessment-relevant facts and are not used to train AI models.

9. Service availability and changes

The service is provided on an “as available” basis. We may modify, suspend, or discontinue features, and may update these terms; material changes will be posted on this page with an updated date. Continued use after changes take effect constitutes acceptance. We may suspend access for misuse under section 4.

10. Liability

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under the law of England and Wales.

Subject to that: (a) we are not liable for decisions taken in reliance on outputs, which are provided for the purposes described in section 3; (b) we are not liable for indirect or consequential loss, loss of profit, revenue, business, goodwill, or data; and (c) our total aggregate liability arising out of or in connection with the service in any 12-month period is capped at the fees you paid to us for the service in that period.

You acknowledge that this cap is reasonable given the nature and price of the service, the availability of practitioner review as a paid option, and your obligation under section 3 to seek qualified review before relying on outputs.

11. General

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If any provision is found unenforceable, the remainder continues in effect. These terms, together with the Privacy Policy, are the entire agreement between us regarding the service. You may not assign your rights under these terms without our consent.
